Warranty Information

Limited Warranty

Trystar warrants products and parts (the “Products”) which are manufactured by Trystar, LLC including d/b/a’s of Load Banks Direct, Controlled Power Company and f/k/a TPMG, (individually and collectively “Trystar” or (“Seller”) against operational failure caused by defects in material or workmanship that occur during normal and proper use within the defined period for the Product as listed below.  THIS WARRANTY IS IN LIEU OF AND EXLUDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  BUYER’S SOLE AND EXCLUSIVE REMEDY IS REPAIR OR REPLACEMENT OF THE TRYSTAR PRODUCT AS SET FORTH HEREIN.

Duration of Limited Warranty

This coverage becomes effective upon the date of shipment of the Product and shall expire as defined below:

If the product purchased is not listed above, please reach out to Trystar for the specific warranty duration certificate.

Trystar®’s obligation under this warranty is limited to the repair or replace, at Trystar®’s option, without charge for materials, subsequent to Trystar®’s inspection and F.O.B. Trystar®’s facility, the product shipped to Trystar® with a return authorization number and warranted hereunder which does not conform to this Warranty.  If replacement parts, components or products are shipped or caused to be shipped by Trystar® prior to inspection of the Product claimed to be defective, the preplacement parts, components or products shall be invoiced in full current price amount and shipped freight collect F.O. B. Trystar® facility.  If Trystar®’s inspection determines that the returned Product is covered by this warranty, user will be issued a credit in an amount equal to the price previously invoiced.  Warranty coverage will be provided only after Trystar®’s inspection discloses the claimed defect and shows no signs of treatment or use which would void the coverage of this Warranty.  All defective products and component parts replaced under this warranty become the property of Trystar®.

Seller shall determine if a Product may refund any part or length of Product that Trystar®’s inspection found to be defective, provided (a) the Product failed during normal, intended, and proper use, and (b) the failure is not attributable to improper or unauthorized application, storage, handling, modification or installation.  All repairs or replacements shall be free of charge, F.O.B. Trystar® facility collect in the continental U.S. delivery point called for in the original order.  Defective Products shall be returned to Trystar® by Buyer, collect, freight prepaid Buyer’s continental U.S. location.

Written warranty for all other component parts used in the manufacture of Trystar® Products is available upon request. Warranty of such component parts will be determined by said component manufacturer upon their inspection of the claimed defective part.

Return Goods

Written permission for any warranty claim must first be obtained from authorized Trystar® personnel prior to return of the Product. All returns must be accompanied with a complete written explanation of claimed defects and the circumstances of operational failure.

No claim shall be recognized by the Seller unless made in writing and notified to the Seller by the Buyer within 30 days of shipment of the Products to the Buyer. In the event Seller agrees to the return of Products by the Buyer, Seller will provide Buyer with a written Return Goods Authorization (“RGA”). Seller will not accept any Products for return without such RGA. The Products shall be at Customer’s risk until such time as the Products reach the Seller’s place of business. The expense of the return shall be borne by the Buyer, unless the Products are deemed by the Seller, in Seller’s judgment, to be defective. In the event Buyer desires to return Products that conform to Seller’s standards and are not defective, and Seller, at its option, agrees to the return of Products, all Products must be in the original packing; not opened or used. Buyer will be subject to a 20% re-stocking fee for all such Products returned.

IN NO EVENT SHALL TRYSTAR® BE LIABLE FOR LOSS OF TIME, MANUFACTURING COSTS, LABOR, MATERIAL, LOST PROFITS, OR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, DIRECT OR INDIRECT, BECAUSE OF DEFECTIVE PRODUCTS WHETHER DUE TO RIGHTS ARISING UNDER THE CONTRACT OF SALE OR INDEPENDENTLY THEREOF, AND WHETHER OR NOT SUCH CLAIM IS BASED ON CONTRACT, TORT OR WARRANTY OR OTHERWISE.

This express warranty is Trystar®’s sole warranty, except as otherwise stated in writing by Trystar®. The sale of Products for Trystar® under any other warranty or guaranty, express or implied, is not authorized. This warranty voids and supersedes all previous warranties.
